By accessing or using NixOS Cloud, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not access or use the service.
2. Description of Service
NixOS Cloud provides a platform for creating and managing NixOS-based virtual machines on AWS infrastructure. The service includes VM creation and management, NixOS integration, and GitHub integration for automated rebuilds.
3. User Accounts
To access certain features of the service, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You agree to provide accurate and complete information when creating an account and to update your information to keep it accurate and current.
4. Acceptable Use
You agree not to use the service for any illegal purposes or in any manner that could damage, disable, overburden, or impair the service.
Specifically, you agree not to:
- Use the service to violate any law or regulation
- Attempt to gain unauthorized access to any portion of the service or any other systems or networks
- Use the service to transmit any viruses, malware, or other harmful code
- Use the service to conduct activities that could be considered abusive, deceptive, or harmful
- Use the service to infringe upon the intellectual property rights of others
- Use the service to process or store sensitive personal data without appropriate safeguards
5. User Responsibilities
You are responsible for all activities conducted through your account and for compliance with all applicable laws and regulations. You are also responsible for:
- Maintaining the security of your account credentials
- Properly configuring and using the service
- Backing up your data and configurations
- Ensuring that your use of the service does not violate any third-party rights
- Complying with all applicable laws regarding the transmission of technical data
6. Intellectual Property Rights
The service and its original content, features, and functionality are owned by NixOS Cloud and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.
Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.
8. Limitation of Liability
In no event shall NixOS Cloud, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the service
- Any conduct or content of any third party on the service
- Any content obtained from the service
- Unauthorized access, use, or alteration of your transmissions or content
9. Disclaimer
Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
